Probate Sale North Coast
To sell a probate house on California's North Coast, Humboldt, Shasta, Mendocino, you need Letters from your county's Superior Court, then the sale runs by your authority level. With full authority under the IAEA, you sell much like a normal home in this affordable region (benchmarks $380,000 to $440,000) after a 15-day heir notice. With limited authority, the court confirms the sale at a hearing where buyers can overbid.

A probate sale isn't sold 'outside' probate, it's sold through it, and the mechanics depend on the authority the court grants. Here's the process, from establishing authority to closing. Ashlar LDA can prepare the filings; a probate attorney handles legal advice on complex estates:
File the petition for probate with the Humboldt, Shasta, or Mendocino County Superior Court to be appointed and receive Letters Testamentary (executor, named in a will) or Letters of Administration (administrator, no will). These grant your legal authority to act for the estate. The petition requests full or limited IAEA authority.
This is the pivotal distinction. Full authority under the Independent Administration of Estates Act lets you list, accept an offer, and close without a court-confirmation hearing: you send a 15-day Notice of Proposed Action to heirs, and if none objects, you close like a standard sale. Limited authority requires court confirmation of the sale.
Under full authority, you give heirs 15 days' written notice of the proposed sale terms. No objection means the sale proceeds directly to a normal 30 to 45 day close, reducing the timeline by 2 to 4 months versus court confirmation.
With limited authority, the accepted offer goes to a confirmation hearing (typically 30 to 45 days out) where the court opens the floor to overbids. The first overbid must exceed the accepted offer by a statutory formula: 10% of the first $10,000 plus 5% of the balance. On a $500,000 accepted offer, the minimum overbid is $525,500. Buyers at the hearing should have financing fully underwritten.
The sale price must be at least 90% of the property's probate appraisal (set by the court-appointed Probate Referee). If more than a year has passed since the appraisal under limited authority, a reappraisal is required before confirmation, since it sets the minimum acceptable price.
Whether full or limited authority, the property still needs proper pricing, disclosures, access, and marketing. A probate-experienced brokerage manages the sale to fit the court timeline; overall California probate typically runs 9 to 18 months.
Full authority is usually worth pursuing: it eliminates the court-confirmation hearing and the overbid risk, closes 2 to 4 months faster, and gives buyers the confidence of a standard transaction. Most estates with a valid will (and heir cooperation) can obtain it, request it when the petition is filed. Ashlar LDA can prepare that petition.
One family. Two ways we help.
Selling a home through probate means two jobs at once: the court process and the sale itself. Serve First Realty lists and sells the property as a probate-experienced brokerage, and our affiliated company Ashlar LDA, Inc., a bonded and registered Legal Document Assistant, can prepare the probate filings many executors would otherwise pay an attorney to draft: the petition for probate, the Notice of Proposed Action, and related documents, at a lower cost for straightforward matters. One coordinated team, from petition to closing. (A Legal Document Assistant prepares documents at your direction and is not a substitute for an attorney where legal advice is needed; complex or contested estates may require an attorney.)
File the probate petition with the Humboldt, Shasta, or Mendocino County Superior Court to receive your Letters, and request full IAEA authority, which makes the sale far simpler. Ashlar LDA can prepare the petition.
Probate sales have their own disclosures, timelines, and buyer expectations. Serve First prices and markets the home to fit the court process, whether you have full or limited authority.
Under full authority, we coordinate the 15-day Notice of Proposed Action. Under limited authority, we prepare for the confirmation hearing and manage the overbid process.
Once the sale closes, proceeds flow to the estate for distribution. We coordinate timing so the sale aligns with the broader administration.

Estimate your proceedsOnly if you have limited authority. With full authority under the IAEA, you can sell without a confirmation hearing, just a 15-day Notice of Proposed Action to heirs. Most executors request and receive full authority, which makes the sale much simpler.
Full authority (IAEA) lets you sell real property without a court-confirmation hearing; limited authority requires the court to confirm the sale, including a public overbid hearing. The level is set when the probate petition is filed and shapes the entire sale process: timeline, offers, and buyer pool.
At a confirmation hearing (limited authority), other buyers can bid against the accepted offer. The first overbid must exceed it by 10% of the first $10,000 plus 5% of the balance, so a $500,000 offer requires a minimum overbid of $525,500. Overbidders should have financing fully underwritten before the hearing.
No. The sale price generally must be at least 90% of the probate appraisal set by the court-appointed Probate Referee. Under limited authority, if the appraisal is more than a year old, a reappraisal is required before confirmation.
Overall California probate typically runs 9 to 18 months. The sale itself is faster with full authority (a standard 30 to 45 day close after the 15-day notice) than with limited authority, where the court-confirmation hearing adds 2 to 4 months.
